Sex offenders banned from child care work

Those with a history of child abuse will be banned from working in education, training and nursing involving minors for an appropriate period in Changning District, according to the district procuratorate yesterday.

So far 10 offenders have been blacklisted.

Changning District People’s Procuratorate’s opinion on recruitment and employment was co-signed by eight district departments including the police and education bureau.

The length of prohibition ranges from three to five years under the criminal law, but in certain circumstances, the ban can be longer based on administrative regulations. “For example, the 14th article of the Teachers Law prohibits those who have been deprived of their political rights or given custodial sentences from working as teachers,” said You Lina with the procuratorate.

Minhang District has had a database of convicted sex offenders and very strict recruitment and disclosure criteria since 2017. Changning has gone further, excluding those with records of domestic violence or drug use.

The posts covered are not only those in direct positions of care like teachers, coaches and childminders, but also security guards, drivers, cleaners and volunteers.

The document stipulates that the job seeker must honestly report any criminal record when applying for a job, while the employers should be rigorous in background checks.

In one case handled by the procuratorate in 2017, a tutor was found to have molested several girls under 12. He concealed his past from his employer, having left another training school following similar offenses. The procuratorate suggested the district court ban him from working in related industries for five years, which the court duly did, said Huang Dongsheng, deputy chief procurator.

Last year the procuratorate made spot checks on 36 kindergartens, 23 primary school, 25 middle schools, and a vocational school in the district. It found a calligraphy teacher with a previous record of sexual assault working with an unlicensed private organization offering after-school care. He was removed from his position.

The Shanghai People’s Prosecutors’ Office is working on recruitment and employment of sexual abusers and has made some progresses. If the Changning policy is effective, it may be reproduced in other districts.
