China welcomes US ruling tire duties 'unreasonable'

CHINA has welcomed the decision of the United States Court of International Trade to rule the US Department of Commerce as "unreasonable" for its imposition of anti-dumping (AD) and countervailing (CVD) duties on tires from a Chinese maker, the Ministry of Commerce said yesterday.

The US court has ruled that duties imposed on Hebei Starbright Tyre Co Ltd might cause double counting as, while the department may have the authority to apply the duties, statutes were unclear as to how the department was to account for the overlap when imposing both CVD (additional duties imposed to offset government subsidies in the exporting country) and AD.

The US court ruled that the department either scrap the CVD or amend its procedures of levying AD and CVD within 90 days.

China believes the dual imposition of AD and CVD infringed US rules and its tradition of not adopting anti-subsidy measures against non-market economies.
