Apple, Proview resume talks over iPad trademark
Apple Inc has resumed talks with Shenzhen Proview to solve the iPad trademark dispute and Apple may buy the trademark at a "reasonable" price but much lower than the estimated US$400 million, Shanghai Daily has learned.
"With the court's attempt (to mediate), Apple is returning to the negotiation table," said Ma Dongxiao, Proview's lawyer, in phone interview yesterday.
"I can't tell you Proview's asking price but it is lower than US$400 million," Ma said, noting that Apple had been "too arrogant to negotiate" with Proview.
Apple China, however, declined to comment yesterday.
Early this year Shenzhen Proview, which owns the iPad trademark in the Chinese mainland, sued Apple for trademark infringement and asked it to stop selling iPad in the mainland.
The Chinese government regarded Shenzhen Proview as the rightful owner of the iPad trademark, according to a remark by Fu Shuangjian, deputy director of the State Administration for Industry and Commerce, in April.
The Guangdong Province Higher People's Court tried to arrange a settlement of the case, in which Apple claims it bought the IPAD name from Proview Taiwan in 2009 for UK$35,000, but Proview claims that its Shenzhen affiliate is the only company that has the legal right to sell the name for use in the Chinese mainland.
For the debt-ridden Shenzhen Proview, the case is probably its last chance to pay off debtors, including several state-owned banks.
