Drugmaker wins court case over herbal tea

GUANGZHOU Pharmaceutical Group said yesterday it will keep working with retailers and suppliers to promote its herbal teas after a Beijing First Intermediate Court ruling confirmed its ownership of the Wong Lo Kat trademark.
Hung To (Holdings) Co's appeal to withdraw a ruling by the China International Economic and Trade Arbitration Commission in May was denied by the Beijing court in a final ruling, Guangzhou Pharma said in a filing to the Shenzhen Stock Exchange over the weekend.
The pharmaceutical company said at a press briefing yesterday that it will keep seeking partners to promote its herbal teas and it did not rule out the possibility of collaborating with Hung To, 21st Century Business Herald reported.
Guangzhou Pharmaceutical General Manager Wu Changhai told the newspaper production of its herbal tea products will rise 10 times in July from that of June, without giving exact numbers. The company will also work more closely with retail outlets.
Hung To said last week that a trademark licensing contract between itself and Guangzhou Pharmaceutical allows it to use the trademark exclusively until January 2013 and it will file for arbitration to ban the company from using the brand.
Guangzhou Pharmaceutical yesterday said the trademark licensing agreement was void.
Guangzhou Pharmaceutical shares have gained 36.4 percent since July 2.
