Bank, store must repay in fake debit card case

A bank and a jewelry store were ordered to shoulder most of the losses after a customer saw more than 450,000 yuan (US$71,140) swiped out with a cloned debit card, a local court ruled yesterday.

The jewelry store was ordered to pay back 227,000 yuan for not checking the card owner's information and signature carefully. The card was also used to spend 224,000 yuan at a department store and to withdraw 5,000 yuan from an ATM, all in neighboring Zhejiang Province.

The victim, a Shanghai native surnamed Luo, brought the bank and the two stores to court to settle the issue of compensation. Judge Gu Quan said it could not be determined if Luo or the bank was responsible for the card password leak, which enabled the effective card cloning.

Only the department store checked the card number and signature before granting the purchase, so the bank and Luo each were on the hook for half of the 224,000 yuan.
