Man charged with detaining woman over boyfriend's debt

A MAN was arrested yesterday for allegedly detaining a woman who had acted as guarantor of a loan.

Jin Jingjiang, 21, a Zhejiang Province native, was charged with illegal detention. Another suspect, nicknamed Ke, who is said to have asked Jin to detain the victim, is at large.

On the morning of August 24, 2008, the victim, Sun Wen, a waitress in a nightclub, was driving home when a minibus blocked her way. Several men got out of the minibus, dragged Sun out of her car and forced her into their vehicle, Minhang District prosecutors said. They said Sun was taken to Ningbo, Zhejiang Province, by Ke and Jin where Ke asked the woman to return 1 million yuan (US$146,157) her former boyfriend, Bao Duoyi, owed to Ke.

Sun had signed her name on a document guaranteeing payment of the loan.

But Sun said she was unable to pay. Ke left the next morning and when Jin released Sun, she went to the police.

Sun told prosecutors she had signed as guarantor for a loan for Bao one night in January 2007. At the time, Ke told Sun her signature was just a formality and she wouldn't bear any responsibility for the debt. Soon afterward she broke up with Bao and now had no idea where he was.

"But now Ke is forcing me to pay the debt because he can't find Bao," she said. "He also threatened to kill me if I didn't give him the money."

Jin is said to have told police after he was caught that Ke, a fellow villager of his, asked him to help get money from Sun and promised to pay him. Jin said he didn't know Ke's real name.

Prosecutors said creditors should seek legal help to ask for debt payment. If they detained debtors as the two suspects are alleged to have done, they would be punished by the law.

They said people should not act as warrantors without due consideration. And they said creditors couldn't demand debt payments in illegal ways even if they had the right to ask the debtors to pay.
