Michelin wins infringement lawsuit

MICHELIN has won a trademark infringement lawsuit against a local advertising company that published a commercial dining guide of Shanghai on a magazine using a trademark similar to the world-famous Michelin Red Guide, the Shanghai No.2 Intermediate People's Court said yesterday.

The Shanghai-based Urbanatomy Media was ordered to pay 60,000 yuan (US$9,406) to Michelin for an article about Shanghai's French food published in the English-language magazine That's Shanghai in November 2010.

Urbanatomy Media and That's Shanghai magazine published a dining guide titled "The Micheling Guide to Shanghai Restaurants 2010," which reviewed more than 10 French-style eateries in Shanghai. Michelin charged that the "Micheling" in the title was clearly designed to mislead readers.

The court said Urbanatomy infringed the registered trademark of Michelin by using similar patterns and pictures, and the word "Micheling" in the magazine was similar to the genuine one.

The magazine was fined 30,000 yuan for infringing Michelin's trademark in January by the Shanghai Industrial and Commercial Administrative Bureau.
