Model wins photo infringement case

A MODEL whose photo was published in a Shanghai sex health magazine has won a lawsuit against the publisher and 1,000 yuan (US$160) in compensation, Baoshan District People's Court said yesterday.
The woman surnamed Yin, in her 20s, told the court she saw her photo in the magazine last summer after her friends told her about it.
The court heard the magazine, published by a local hospital, contained vulgar content and adverts to treat sexual diseases and infertility. Many of Yin's relatives, friends and neighbors saw the magazine.
Yin said the magazine had infringed her rights and caused her a lot of stress. She demanded the hospital publish an apology in a newspaper, destroy the remaining copies and pay 10,000 yuan in damages.
The hospital argued it was a coincidence Yin looked like the model in the photo and denied all the accusations.
The court said Yin was the woman in the photo. It ordered the magazine to apologize, destroy the remaining copies and pay 1,000 yuan in damages.
