Payout for patient hit by car at hospital
A HOSPITAL was ordered to pay a 57-year-old woman more than 1.2 million yuan (US$184,164) after she was hit by a car driven by one of its security guards, the Pudong New Area People’s Court said yesterday.
The security guard, who did not have a driving license, tried to move the car parked on the road in front of Yangsi Hospital in the Pudong New Area because it was blocking traffic, the court said.
According to the court, the car’s owner, surnamed Ye, took his pregnant wife to the hospital on the morning of August 6, 2014. He left his car on the road with the engine still running while he went inside with his wife, blocking motorists trying to enter and leave.
The security guard, surnamed Zhang, then decided to move the car, but he lost control and crashed into the woman, a pedestrian surnamed Zhu, who was seeking medical attention for a fever.
Zhu suffered several serious fractures and a spinal-cord injury.
The court sentenced Zhang to 18 months in jail with a two-year reprieve for negligently causing serious injury.
To obtain compensation for Zhu’s expensive hospitalization, her family filed a civil lawsuit against the hospital, the car owner Ye and the insurance company.
The court ruled that since Zhang was an employee of the hospital, it was responsible for his actions.
Ye, who was deemed guilty of negligence, and his insurance company were ordered to pay Zhu 420,000 yuan.
