Subcontractor ordered to compensate injured worker

A subcontractor was ordered to pay compensation to an injured migrant worker who he denied was his employee, a local court said today.

Wang Long, the subcontractor, was ordered to pay the victim more than 230,000 yuan in compensation while the project contractor, a local company, was required to share the compensation.

On March 14 last year, the worker, Xiao Yi, was hit in the head by a falling piece of iron from a high-rise building under renovation on Nanjing Road W. The injury left Xiao with mild disability.

But Wang insisted that he did not know the victim and had no labor relationship with him because Xiao was introduced to the construction site by the project manager. The company that subcontracted the project to Wang also denied labor relationship with Xiao in the court.

The court said Wang should take the responsibility for the accident because Xiao was injured while working. Besides, Wang was not qualified for the project.

According to China's Social Insurance Law, the employer should pay for each employee's social insurances, including the work injury insurance. Employees can apply for compensation from the national fund if they are injured in work-related accidents.
