Brewery pays boy for injury from bottle blast

A local beer company was ordered to pay more than 150,000 yuan (US$22,762) in compensation to a five-year-old boy whose eye was hurt when a beer bottle exploded.

The eyesight of the boy's left eye dropped sharply after treatment and the eye could only see things vaguely, the Songjiang District People's Court said today.

The court declined to reveal the brand of the beer, saying it was a popular brand.

The boy was playing in the yard of his grandfather's home one day last September when a beer bottle placed on the cement ground exploded and injured his eye.

The boy was rushed to the hospital but his eyesight could never recover.

The boy's parents blamed the accident on the poor quality of the beer bottle and asked for a compensation of 230,000 yuan.

The brewery argued that the blast was caused by improper placement of the bottle by the boy's grandfather, who left the bottle in the sun for long hours and the high temperature caused the blast. The brewery said its label on the bottle instructed people to keep beer in low temperature.

A judicial examination found the bottle did not have an embossed letter of B near the bottom. According to the national standard, letter "B" should be embossed to show the bottle is especially made to hold beer. If there is no B, the bottle can be judged substandard.

The examination report also said the explosion was caused by external force. Based on the report, the court ruled that the brewery had 70 percent of the responsibility for the accident.
