Child rights toughened as rules change on guardians
RULES have changed on guardianship to protect children’s rights.
According to a policy released yesterday, relatives, neighborhood committees, civil affairs departments, schools, hospitals and related organizations can submit applications to a court to revoke the guardianship of parents or authorized guardians if they refuse to perform their custody duties for more than six months.
In other circumstances, parents or guardians may also face risk of losing their custody rights, such as in cases of children being endangered by being left unattended, or impairing children’s physical and metal health by violently abusing, maltreating or abandoning them.
The policy mainly targets children under 16 years old in three types of situations — those suffering abuse, abandonment, or accidental injury due to the absence of a family guardian; those from poor families and having difficulties seeking medical service and education opportunities; and disabled children with difficulties in rehabilitation, nursing and fitting into society.
Released ahead of Children’s Day on June 1, the policy aims at protecting the rights and interests of minors across various fields — including health care, compulsory education and judicial protection.
The new policy requires that schools, kindergartens, hospitals, neighborhood committees, social service agencies, salvage-service organizations, welfare sectors should report to police if they find children living alone without guardians, suffering from family violence, accidental injury or other illegal infringements.
The organizations will be held liable if they fail to do so. Police are also required to take immediate action after receiving such reports.
Parents and guardians will also be punished if they maltreat or abandon children. They will be warned by police in minor cases, but will receive an administrative penalty if they refuse to rectify their behavior. They will be charged if crime is involved.
