Couple wins suit against Parkson

A PARKSON department store in downtown Shanghai was ordered to pay a couple 100,000 yuan (US$16,340) who were badly injured after falling from the store’s escalator, the Huangpu District People’s Court announced yesterday.

The couple, who are from Jiangsu Province, fell off the escalator at the Parkson store on Huaihai Road when it suddenly stopped and started shaking on September 17, 2012. Parkson’s staff rushed them to Ruijin Hospital where doctors confirmed they had fractures.

The husband, surnamed Gu, fractured his ribs, while his wife, surnamed Shao, who had pleural effusion before, only got worse after radius fracture.

The couple filed a suit in  the court and demanded 250,000 yuan as compensation from the store in March.

Parkson admitted the escalator malfunctioned and caused the accident, but claimed the couple was partially to blame as a surveillance video showed they did not hold the handrail.

Parkson argued that other customers who were on the  same escalator were not injured when the accident happened.

The court said Parkson was  responsible for the injuries to the couple and that its evidence was not conclusive that the two were at fault.

In September last year, a woman, 35, died after falling six floors down an elevator shaft in Hualian Commercial Building on Nanjing Road E. The woman stepped into an elevator shaft whose door was open.
