'Dead' man returns only to find home sold by daughter
AFTER being missing for 10 years and declared dead, a deaf-mute local resident returned home only to find his apartment had been sold by his daughter.
A local court yesterday ordered the daughter of this deaf-mute man surnamed Wang to pay 400,000 yuan (US$9,555) in compensation since she refused to live with her father.
Wang used to live with his daughter in an apartment on Caobao Road after he was divorced in 1992.
Troubled with business failure and debts, Wang left Shanghai in early 2000 to avoid creditors, leaving behind his daughter who was in her early 20s.
Wang was declared dead by the Minhang District People's Court in September 2006 at the request of his daughter who had not heard anything from him.
Afterwards, his daughter sold the apartment on Caobao Road as the sole property owner and bought another apartment in Putuo District.
Wang returned in October 2010 to everyone's surprise. He was also astonished to find he had "died" four years ago and had no place to live. His death status was soon removed.
Since his daughter refused to accept him, Wang sued to the Putuo District People's Court, asking to live in his daughter's new apartment or get compensation from his daughter.
The daughter told the court that Wang was an irresponsible father. After he left home, she had to endure threats and harassment from creditors for years. She refused to live with her father and pay compensation.
The Putuo court ruled that the daughter had an obligation to take care of her father and should compensate for her father's property since she was already an adult when he left home.
