Divorced couple accept court mediation over boy’s custody

A 2-year-old boy, born through artificial insemination, is to live with his mother until he reaches 3 and then live with his father until he is 10, according to the Baoshan District People's Court that mediated for a divorced couple.

The court said the boy's parents accepted the court mediation yesterday and signed their names on official documents.

The mother, surnamed Zhang, gave birth to the boy in 2011 after artificial insemination because her husband, surnamed Yang, has chromosome disorder and is unable to reproduce. After divorcing over unhappy marriage, both fought for the baby’s custody. Yang offered Zhang 200,000 yuan in exchange for full custody, but Zhang refused.

Unable to reach a solution, they brought the case to court.

In most cases, a child's custody is awarded to the mother but the Baoshan court tried to make a win-win solution for the couple. It noticed that Yang is not the boy’s biological father. That means if he lost the custody, the boy would not be able to enjoy his fatherly love. Yang is also wealthier and lives in a suburban house. He can provide better life and education for the boy.

The court said the boy's living cost will be shared by both parents until he reaches 10 years old and can choose whom to live with.
