Expat whose car killed pedestrian loses case
A local court yesterday rejected an appeal by an expat from the Middle East who tried to seek insurance compensation after crushing a Chinese pedestrian to death in a traffic accident.
The expat, surnamed Meguid, whose nationality was not revealed, was sentenced to 10 months in prison and was ordered to pay 650,000 yuan (US$103,000) to the victim's family by the Hongkou District People's Court.
After Meguid was released, he filed a lawsuit against his car insurance company, demanding it pay 500,000 yuan more compensation even though it had already paid 120,000 yuan to the victim's family.
In court, Meguid said his car was insured for 500,000 yuan in third-party liability and insisted he deserved the compensation. But the insurance company refused to pay on the grounds that Meguid was a hit-and-run driver.
Meguid had the accident about midnight on September 17, 2009 when his car ran over the sidewalk and killed a Chinese pedestrian named Wu Jianwei. After checking Wu's injuries, Meguid abandoned his car and ran from the scene, the court heard.
However, the expat argued he left a business card at the scene and left because he was "afraid of being beaten up" by gathered onlookers. Wu died of severe head injuries after hospital treatment, the court heard.
