Female model wins portrait piracy case

A young model whose photo was published in a sexual health magazine in Shanghai has won a lawsuit against the publisher and 1,000 yuan (US$160) in compensation, the Baoshan District People's Court said today.

The woman surnamed Yin, in her 20s, told the court that she saw her photo in the magazine last summer after some friends told her about it.

The court heard that the magazine, published by a local hospital, was full of vulgar contents and advertisements of treatment for sexual diseases and infertility. Many of Yin's relatives, friends and neighbors saw the magazine that was distributed free on the street.

Yin said the magazine had infringed on her rights and given her extreme pressure. She demanded the hospital to publish an apology in a local newspaper, destroy the remaining copies and pay 10,000 yuan in damages.

The hospital argued that it was pure coincidence that Yin looked like the model in the photo and denied all the accusations.

The court said Yin was the woman in the photo and ordered the magazine to apologize to the victim, destroy the remaining copies and pay only 1,000 yuan to Yin because only a small amount of copies were distributed in Baoshan District.
