Hit-and-run driver gets murder sentence
A driver has been sentenced to 11 years in prison for knocking down a woman and leaving the wounded victim on the road, causing her to be crushed to death by following vehicles.
The Shanghai No. 2 Intermediate People's Court convicted the driver, surnamed Yang, of murder because he should have known the danger of leaving an injured person on a highway.
Yang was also ruled to pay 272,000 yuan (US$41,026) in compensation to the victim's family.
Yang drove a car for home on the rainy night of February 6, 2010 with a friend when the car hit a woman on Huyi Highway in Jiading District. Yang went out to check and saw a woman lying under the front wheel. He pulled the woman out and heard her groan. But he didn't send her to hospital. Instead, he drove off after putting the victim on the highway, according to the testimony of the passenger, surnamed Zhao, in Yang's car.
Yang later called his brother-in-law, surnamed Xu, and surrendered to police, accompanied by Xu.
He was told by police that the victim, only 24, had been crushed by following vehicles and died of brain injury.
Though Yang argued in court that his car had killed the victim already and it should be a traffic accident, a surveillance camera had recorded everything.
The video tape showed Yang's car didn't hit the victim's head. After he left, the victim was crushed by three passing trucks in a few minutes.
The judges said the victim could have been saved if Yang had sent her to hospital in time. Since he left her in a dangerous situation and his negligence led to her death, he should be charged with murder.
