Man loses fight to get job back after using 'home leave' allowance to take European holiday
A MAN who was fired for using his “home leave” allowance to take a European holiday has lost his legal action for unfair dismissal, the Shanghai No. 2 Intermediate People’s Court said yesterday.
The plaintiff, surnamed Song, who worked for an office in Shanghai, filed the case after being sacked in August last year.
He was dismissed after his boss discovered that the 10 days’ home leave Song had been granted to visit his family in Beijing was used for a trip to Italy.
Song initially took the case to his local arbitration commission, which ruled partly in his favor, suggesting the employer pay him until the end of his contract.
It did not, however, recommend he be reinstated.
Dissatisfied, Song took the case to court, which ruled against him, saying “home leave” is specifically designed to give people working away from home the chance to see their families, and should not be used for other purposes.
