Paralyzed student seeks 1.57m yuan from lover
A 17-YEAR-OLD girl who suffered a brain hemorrhage after having sex with a man she had met on the Internet is seeking compensation of more than 1.57 million yuan (US$231,905), blaming him not helping her in time.
The parents of the girl, called Wen in court, attended the hearing at Hongkou District People's Court yesterday on her behalf.
They said Wen was paralyzed and couldn't speak. She was facing long-term therapy and the compensation was needed to cover her medical costs.
The defendant, surnamed Shen, said he would pay 50,000 yuan at most out of sympathy because he was not at fault for Wen's condition.
Shen, in his twenties, said he met Wen online in July 2008. They had a meal together three months later and had sex for the first time.
On March 7 this year, Shen asked Wen to meet him in a hotel in Hongkou District. Wen arrived at noon. After they had sex, Wen complained of a headache and was sick at around 2:30pm, Shen said.
"She went into the bathroom but didn't come out for a long time. When I went to have a look, she was lying on the ground unconscious," Shen said. Wen began to foam at the mouth and her body was twitching. Shen called an ambulance at about 4pm.
Wen's parents said she was preparing for college entrance examinations at the time. They didn't know she had a boyfriend.
They accused Shen of not sending Wen to hospital in time, causing Wen to miss the best time to receive medical treatment. Shen, as an adult, had an obligation to provide emergency aid, they said.
Shen said he had actively helped Wen but it was unreasonable to require him to judge the seriousness of Wen's condition.
The court didn't hand down the verdict after Shen refused to accept its mediation.
