Payout for senior who slipped on vomit

A LEADING city hospital has been ordered to pay 38,000 yuan (US$5,970) to an elderly patient who broke his wrist after slipping on vomit.

The People’s Court in Jing’an District ruled that the hospital, which was not named but was said to be one of Shanghai’s top medical centers, was partly liable.

It had not kept its environment safe, said the court.

However, the court rejected claim of the man, surnamed Liu, for higher compensation, saying that he should also have been more alert.

The court said Liu was elderly without giving his age.

On March 27 last year, Liu went to the hospital for a scan. While walking along a third floor corridor he slipped on a pool of sick.

It was found that Liu had fractured his right wrist and he underwent an operation.

Liu said he had not noticed the pool of vomit as he was looking at signs on doors to find the scanning room.

He said it was the hospital’s failure to clear up the mess that caused him to break his wrist and asked for 62,800 yuan in compensation.

But the hospital said a patient had been sick just before Liu passed and he slipped before cleaners could arrive.

The court judged that the hospital was partly liable as it had failed to clear the mess.

But Liu should also bear some responsibility as hadn’t been alert to the hazard.
