Pilot on trial for forging work resume
THE Shanghai-based Spring Airlines is suing a German pilot for fabricating his work experience, claiming it was misled into hiring him as a flight captain.
The Shanghai No.1 Intermediate People's Court heard the case yesterday after the airline appealed an earlier ruling against it at the Changning District People's Court.
The airline is seeking more than 850,000 yuan (US$136,850) in compensation from the pilot whose name was not revealed.
Spring Airlines said it hired the pilot in 2010 through Continental Aviation Association, a Hong Kong-based agent, for a monthly salary of US$11,000, besides offering him a housing allowance of 13,000 yuan and oil-saving awards.
In May 2011, the airline received a tip-off saying the pilot had exaggerated his work experience in the resume.
After investigation, the airline found he was not qualified for the captain's job as he was a co-pilot, who had also faked his experience as an instructor.
The pilot was stopped from flying from July 7, 2011.
The airline demanded that the pilot return some of the payments made to him - salary, training and agent fees, accommodation, etc - totaling over 850,000 yuan.
It also presented documents in the court from Air-Espace Flight Academy in Switzerland and Air Astana which stated that the pilot papers were forged.
The pilot's lawyer insisted that he was qualified for the captain's job and argued that the forged statements should not be taken as evidences since they were not notarized.
In the earlier verdict, the Changning court said that while the statement from Air-Espace proves that the resume was false and that the airline was misled, he completed all the flight missions and his work was not affected due to the forging of the resume.
The court asked the airline to pay 16,116 yuan in back pay to the pilot and issue a leaving certificate while rejecting the rest of the compensation demand. It suggested Spring Airlines demand repayment from the agent for introducing under-qualified pilot.
