Snack firm tastes success in packaging patent case

SNACK manufacturer Po-Li Foods Industry Company won a copyright infringement case against a company that produced similar-looking products, the Shanghai No.1 Intermediate People's Court said yesterday.

Po-Li was awarded 73,000 yuan (US$11,545) compensation for the infringement by Beijing Northern Green Giant Food Company.

It had discovered the Beijing company was selling egg rolls - flute-shaped pastry often eaten as a sweet snack or dessert - with an exterior package that infringed Po-Li's best-known egg rolls.

Northern Green Giant's egg rolls have been widely sold in supermarkets in Shanghai and Beijing since July 2010, the court heard.

Po-Li demanded more than 400,000 yuan compensation, saying the Beijing food company infringed its patented product packaging and misled customers.

The Beijing company argued it had printed its product name, "Old Beijing Manual Egg Rolls," clearly on its packages.
