Suning fined after customer sold model phone

CHINA'S biggest home appliance retailer has been ordered to compensate a Shanghai customer who was sold a model cellphone instead of the real thing.

Suning Appliances was told to pay the customer, surnamed Fu, 8,150 yuan (US$1,311) at the Shanghai No.1 Intermediate People's Court.

Fu paid 5,150 yuan for a phone at a local Suning outlet on June 10 last year, the court heard.

But on opening the packaging, he was shocked to find the phone was actually just a model.

A shop assistant took back the cellphone and called police to investigate.

But the store didn't give Fu a replacement cellphone until August 27, which led him to file a lawsuit accused Suning of fraud and demanding his payment back with compensation.

A lower court had ruled Suning should return the payment and pay 5,350 yuan in compensation.

Suning appealed to the intermediate court, arguing that it didn't cheat the customer.

The intermediate court agreed that Suning hadn't cheated him.

But it ruled the company should return the payment and pay 3,000 yuan compensation as it hadn't given Fu his replacement cellphone in time.
