Carrefour sued over sacking pregnant worker


A CARREFOUR store was brought to court over labor disputes in Beijing.



The case was first heard by Beijing Fengtai District People's Court on June 21, today's Procuratorial Daily reported.



A worker named Sheng Zang told the court that she was asked to resume a job at Carrefour but sign the labor contract with Guangzhou Nanfang Personnel Co last year after one year's work at the French hypermarket.



To secure her job, she agreed. But when she became pregnant in April 2009, she was fired.



Sheng sued Carrefour and Nanfang in June, demanding unpaid wages. Her lawsuit was thrown out by the court, which said her labor contract with Nanfang had nothing to do with Carrefour.



Lawyers blamed Carrefour for shirking its employment responsibilities by having a third company act a labor broker. In this way, Carrefour can pay less to contract workers than those on its own payrolls, they said.


Bai Yu, a lawyer with Beijing Zhicheng Law Assistant Center, said many hypermarkets are using labor in this way.



Nearly all the hypermarkets require workers to sign the labor contracts with a third company, she said, citing the center's research.



Hypermarkets can thus pay less in social insurance funds and taxes for the workers as well as be exempt from any responsibilities in case of a work accident.
