Couple appeal against family planning fine
A COUPLE argued in an appeal court that because their first child was born in Hong Kong they should not be fined almost 200,000 yuan (US$32,520) for having a second child.
The husband, surnamed Liang, and his wife, surnamed Lan, said that as only their second child was born on China’s mainland, they adhered to China’s one-child policy, the Yangcheng Evening News reported yesterday.
The couple, from Zhuhai City in south China’s Guangdong Province, also argued that the fine is too high.
Liang told the Zhuhai Intermediate People’s Court on Monday that he is the family’s sole breadwinner and is only working part-time.
The couple traveled to Hong Kong in 2008 and their son was born there and lived there until he was 3.
Last year Lan gave birth to a second son in Zhuhai. Jinwan District family planning authority told the couple to pay a fine of 197,868 yuan — based on 6 times the average Zhuhai salary.
They took the authority to court and after losing the case appealed.
No verdict was announced by the court yesterday.
