Court finds TV scriptwriter plagiarized novelist’s work

POPULAR Taiwan romantic novelist Chiung Yao has won her plagiarism case against mainland scriptwriter Yu Zheng, a Beijing court announced yesterday.

The capital’s No. 3 Intermediate People’s Court said Yu and four companies involved had been ordered to pay Chiung 5 million yuan (US$805,444), while Yu had to issue a public apology.

The companies were also ordered to stop the distribution and broadcast of a TV series.

Yu’s studio said he would be appealing the verdict.

At hearings earlier this month, the court heard claims from Chiung that the plot of TV series “The Palace: The Lost Daughter” had been copied, almost in its entirety, and without her permission from her novel “Mei Hua Lao” (Plum Blossom Scar).

“The Palace: The Lost Daughter” aired on Hunan Satellite TV on the mainland, while “Mei Hua Lao” had been adapted for television in 1993.

Chiung had demanded compensation of 20 million yuan.

She said the defendants had gained huge profits from plagiarizing her work. She had been writing a new script based on the story of Mei Hua Lao, but the plagiarism had become an obstacle for the shooting of her new TV series and caused her emotional damage, she said.

Chiung asked Yu and television companies involved to stop broadcasting “The Palace: The Lost Daughter” on both TV and the Internet, or release any copies of the series. She asked for a public apology from Yu and for the defendants to pay her legal fees.

Yu denied the plagiarism, saying he was a Chuing fan with no intention of angering her.

Previously, more than 100 Chinese screenwriters voiced support for Chiung by signing a joint declaration and posting it online, saying they condemned all forms of plagiarism and looked forward to justice being done in the case.

Chiung, a household name in China, has produced a number of popular romantic novels and TV series.
