Court reject Shaolin Temple's trademark for instant noodles

A BEIJING court yesterday threw out Shaolin Temple's lawsuit against the trademark authority over its refusal to register its "Shaolin Medicine" trademark for food products ranging from instant noodles to coffee and tea.

The Beijing No.1 Intermediate People's Court upheld the decision by the State Administration of Industry and Commerce trademark department's assessment committee, today's Beijing Times reported.

Shaolin, known around the world for its martial arts monks, applied to register the "Shaolin Medicine" trademark for its food products in August 2004. The committee rejected the application in September 2006, saying the trademark may mislead the public into thinking the food contains medicinal ingredients and can cure diseases.

Shaolin appealed the decision but was denied again last August.

The "Shaolin Medicine" trademark has been long used by the 1,500-year-old temple for its renowned secret medicinal therapies for wounds, the committee insisted.

Shaolin then filed a lawsuit against the committee.
