Firm suing Apple open to talks over 'iPad'
THE lawyer for a Chinese company suing Apple in China over its use of the iPad trademark yesterday indicated that his client would be willing to discuss a settlement.
Xie Xianghui, lawyer for Proview Technology (Shenzhen), said that since no final decisions had been reached in various legal disputes over the issue, both sides are "still able to sit together and reach an out-of-court settlement."
Proview claims ownership over the iPad name on the Chinese mainland. Apple says it bought the global rights to the name in 2009, but that Proview failed to transfer the rights on the mainland as agreed.
Apple had no comment on the issue of a settlement. Spokeswoman Carolyn Wu reiterated the company's belief that Proview had failed to honor its agreement with Apple.
Proview accuses Apple of acting dishonestly when it acquired the rights to the iPad name from its Taiwan affiliate and is seeking to prevent sales of the tablet computers on Chinese mainland. It has filed several lawsuits and has asked authorities in 40 cities to block iPad sales.
A hearing is set for a Shanghai court today.
Meanwhile, Apple has appealed an earlier ruling against it in Shenzhen, a city in southern China's Guangdong Province. The case is set for February 29.
LCD maker Proview registered the iPad trademark in China in 2001 for an "Internet Personal Access Device."
So far, iPads have been pulled from shelves in some Chinese cities but there has been no sign of action at national level.
