Former death-row inmate awarded 1.13m yuan in compensation for wrongful conviction

A prisoner on death row who was later declared innocent in southeastern China today received word he will receive state compensation of more than 1.13 million yuan (US$179,000), a court has announced.

The verdict by an intermediate court in Fuzhou, Fujian Province, was delivered by mail to Nian Bin, 38, who was sentenced to death by the same court in February 2008 for the murder of two children in 2006.

The full amount to be paid includes compensation for depriving him of his freedom and for mental anguish, the court said.

The court contacted Nian?s lawyer and sister on Sunday to ask Nian to accept the compensation. The court officials also planned to go to Nian?s home on Monday to apologize, but Nian?s sister failed to provide his address. The court then mailed the verdict to Nian today.

Nian, who was freed in August, had sought 15 million yuan (US$2.4 million) in compensation from the court for depriving him of his freedom and for medical treatment for insomnia, a heart disorder, as well as prostate and spinal problems.

He also asked the court to publish an apology in major Chinese newspapers like the People's Daily and the Oriental Morning Post, as well as major news portals sina.com and xinhuanet.com.cn, according to the Legal Evening News.

The case dates back to July 2006, when Nian rented an apartment in Aoqian Village from Chen Yanjiao to open a grocery store. His next-door neighbor, Ding Yunxia, also owned a shop.

On July 27, six people from Chen and Ding's families suffered food poisoning. Ding's two children ? 10-year-old Yu Pan and 8-year-old Yu Han ? died.

Traces of rat poison were found in the children and Nian was detained several days later. Police said traces of the poison had been found at his home.

In a submission to the procuratorate, Nian said the two officers had concealed evidence that would have pointed to his innocence and falsified reports about the poison to make him appear guilty.
