Freed prisoner calls for bigger payout

A MAN who was released from prison after serving eight years on death row is appealing against the amount of compensation he has been offered.

Nian Bin, 39, who was freed last August, appealed for 15 million yuan (US$2.4 million) in compensation, but the Intermediate People’s Court of Fuzhou, capital of southeast China’s Fujian Province, ruled he should receive 1.14 million yuan, comprising 590,000 yuan for his loss of freedom and 550,000 yuan for his mental suffering.

Nian, however, was dissatisfied with the amount, so his lawyer, Gongsun Xue, yesterday appealed to the Fujian Higher People’s Court to review the case, the Legal Evening News reported.

Nian had asked the intermediate court to compensate him for medical costs after he was diagnosed with insomnia, a heart disorder and prostate and spinal problems, which he claimed were developed in prison, the Beijing Times said.

“I had to wear shackles every day,” he told the paper in December.

“I couldn’t stretch my body. I was innocent but was repeatedly convicted to death. I was so annoyed.

“My appetite is still not good now. I always feels tremendous pressure in my chest, and I feel hard to get back into the community. My pain hasn’t been relieved,” he said.

Nian was detained after his neighbor’s children, aged 8 and 10, died from food poisoning in July 2006.
