Killer cop tells court that gun misfired

A POLICE officer who shot dead a restaurant security guard when he was drunk told a court that his gun misfired and it was against his nature to start a fight after drinking.

Li Guoqing, 45, of southwestern China's Sichuan Police, was charged with murder for shooting Gao Bang dead at point blank range last June during a business trip to Yunnan Province, China News Service reported today.

Li told Kunming City Intermediate People's Court that he was too drunk to remember anything, but later said the guard had hustled him and tried to beat him up. He said the gun misfired when Gao tried to snatch it.

But his colleagues told court that Li was drunk and started a fight with security guards, suddenly shooting the victim with no warning.

Li's defense lawyer said the family and police had paid Gao's family 650,000 yuan (US$95,240) as compensation six days after the shooting. He said the family is seeking to avoid an immediate death penalty.
