Man gets jail term for raping co-worker
A 42-YEAR-OLD man was sentenced to one year in jail after he sexually assaulted and injured his male co-worker in Beijing, Legal Evening News reported today.
The offender became the first man in modern China to be convicted for sexual offences against another man, the report said.
However, the man was charged of intentional damage instead of raping as the victim was physically harmed during the rape, said the Chaoyang District People's Court in Beijing.
So far, only female rape is recognized by China's modern law and one can face at least three years behind bar for such crime. The sentence can be even heavier if body harm is done during the process, according to Lu Zheng, a Beijing lawyer.
The court was told that the offender, identified as Zhang Hua, was a safety guard in an ice skating club in the capital. He forced his 18-year-old co-worker, whose name was not revealed, to have sex with him and hurt him in their dormitory at the night of August 30 last year.
Zhang offered 20,000 yuan (US$3,027) in compensation to the victim. The court showed leniency as the victim said he could forgive Zhang for what he did and Zhang was cooperative in the investigation.
Lu said the case can be looked upon as a positive step in China's modern law to protect the rights of male-rape victims, the report said.
Some Chinese legal experts have suggested expanding the legal definition of rape but their voices have not received any response yet, Lu said.
