Man suing lawyer raises the stakes

THE father of a student executed for killing a hit-and-run victim to cover up the accident is demanding the victim's lawyer pay him 1 yuan (15 US cents) compensation for mental anguish.

Yao Qingwei asked Zhang Xian to publish a letter of apology with at least 3,000 characters in major media for 30 days and pay 1 yuan for the anguish he suffered when Zhang smeared his family's reputation during his son's trial, according to the China Youth Daily.

Yao has applied to amend his existing lawsuit against Zhang, citing the reason as Zhang's frivolous, irresponsible and inappropriate public comments.

Yao took legal action against Zhang last month, then demanded Zhang to cease his defamatory remarks and false allegations and publish an apology on his blog to restore Yao's reputation.

However, Yao now wants to demand 1 yuan compensation after Zhang continued to make remarks such as "The lawsuit is a boring game. I will play with him" and "Compared with others, Yao's reputation is worthless," according to Lan He, Yao's lawyer.

Yao told China Youth Daily: "Zhang kept saying irresponsible things over the Internet, so I decided to demand compensation."

Zhang said he was not aware of the change but said it was Yao's right.

The lawsuit is likely to stir a new round of public debate which seemed to have ended after Yao Jiaxin, a 21-year-old student of the Xi'an Conservatory of Music, was put to death on June 7.

His father had earlier alleged that Zhang fanned public anger to influence media coverage of the trial by spreading rumors that Yao's family was related to powerful high-ranking officials or rich business people.

He said Zhang had published personal information about members of the family, suggesting Yao Qingwei and his father held major positions in China's military defense industries.

Yao said he was an ordinary worker on an average income. The claims made by Zhang were groundless.

Yao Jiaxin stabbed Zhang Miao to death after he accidentally ran her down last October, fearing a peasant woman would be too difficult to deal with.
