THE parents of an abducted woman who allegedly was raped and strangled by a coerced offender are going to bring a lawsuit today against the man, who had also been kidnapped.
Wang Kejia, 25, was kidnapped and held hostage by eight men in Pingdingshan City, Henan Province. She was then allegedly raped and strangled by Xia Weiye, an employee of a prosecutor's office in the city, who was also abducted by the eight suspects, the Oriental Morning Post reported.
Police said Xia was forced to rape and strangle the woman while the eight suspects were tightening a rope around his neck. The suspects reportedly took photos of the rape to blackmail Xia.
Yet police found no photos in the suspects' digital camera. Hao Zhenyou, the head of Pingdingshan Police's press office said the suspects were not capable of operating the digital camera.
Six of the eight suspects had spent more than 10 years behind bars.
Wang's body was discarded into a 40-meter-deep mine shaft and Xia was released by the suspects and blackmailed for 10 million yuan (US$1.46 million), the report said.
Xia called police as soon as he was released.
Xia was exempted from criminal charges - angering Wang's family - after prosecutors recently launched litigation against the eight suspected kidnappers.
"Xia has no right to continue his life at the expense of my daughter's life," Wang Gengyou, the father of the victim, told the newspaper.
According to China's criminal law, offenders forced to commit crimes can either be exempt from punishment or receive lenient penalties.
"Xia was a coerced offender who did not act freely," Yang Tao, a lawyer from Jiangxi Province said on his blog, "It is reasonable to exempt Xia from criminal charges."
After the incident, Xia was said to be on the verge of a nervous breakdown.
