Prisons suggest commutation from 'death with reprieve' sentence for both former railway minister and Bo’s wife
PRISONS are suggesting sentence commutation for former railway minister Liu Zhijun and Bogu Kailai, who is wife of Bo Xilai, former member of Politburo Presidium, according to statements published online by the Beijing’s higher court.
Liu, 62, was sentenced to death with a two-year reprieve in July 2013 for taking bribes over 64.6 million yuan (US$10 million). While Bo Xilai’s wife, 57, received the same sentence in August 2012 for the murder of British citizen Neil Heywood.
Qincheng Prison in Beijing's suburbs said Liu realized his crimes and took part actively in labor work and group activities during reprieve, by which he was awarded the title of model prisoner in 2014.
For Bogu, she didn't purposely commit crime over the reprieve period, according to Yancheng Prison in Beijing’s neighboring Yanjiao of Hebei Province.
The two prisons have filed a petition to the Beijing Higher Peoples’ Court to have the two commuted their sentences. The court has received their petition, but it didn't say when to make decision.
According to the Criminal Law, people who are given death sentence with two-year reprieve can have their sentence commuted to life jail if they don’t purposely commit crimes over the period.
If they perform well and make great contributions in prison, they can have their sentence commuted to 25 years. But if they deliberately commit crimes, prison will ask the Supreme People’s Court to issue approval of execution.
