Rapist facing longer sentence

A COURT in southwest China’s Yunnan Province yesterday retried a former county official who had previously been sentenced to five years in prison for the rape of a 4-year-old girl.

The People’s Court in Daguan County did not announce a verdict after the close-door 2-hour retrial, Chen Weibiao, the girl’s lawyer, said.

Guo Yuchi, a former official in Daguan, was back in court because prosecutors had appealed the sentence he received as being too lenient. In September, Guo had been convicted of raping the girl after taking her to his apartment.

New evidence presented to the court showed that Guo had gagged his victim to stop her from crying during the attack.

The original verdict had rejected compensation for the girl’s family. But Chen said that Guo had agreed to pay the family 150,000 yuan (US$24,615) in October.

On October 17, the Intermediate People’s Court in Zhaotong City ordered the lower county court to retry the case, two days after prosecutors had appealed the sentence as being “clearly inappropriate.”

Chen said Guo would be facing a longer term in prison, citing a new guideline on tougher penalties for public servants involved in sexual offenses against minors.

The guideline, announced on October 24, was released after a number of sexual assaults on children by government employees and teachers.
