Retrial ordered after ayi jailed 10 years for stealing handset
THE case of a domestic helper who stole a cell phone from her employer in Henan Province has been sent back for a retrial, Zhengzhou Intermediate People's Court said today.
Zhang Yun was handed a 10-year jail sentence and fined 20,000 yuan (US$3,148) by Zhengzhou Guancheng District People's Court on June 12 for stealing a cell phone from her employer after she was not paid on schedule. She appealed to a higher court.
After receiving the appeal, Zhengzhou Intermediate People's Court soon organized a collegiate bench. They found the original judgment was based on unclear facts and sent the case back to the court for a retrial.
The case soon aroused public concern with many people saying the punishment was far too heavy for the crime of stealing.
Zhao Yongchun, vice president of Zhengzhou Intermediate People's Court, told Dahe Daily that the Guancheng court needs to fully investigate whether the defendant knew the value of the cell phone and whether she gave herself up. The value of the cell phone also needs to be reappraised, Zhao told Dahe Daily.
An investigation of the chief judge and other Zhengzhou Guancheng District People's Court employees has begun, the report said.
