Seagull triumphs over Omega in trademark dispute

THE arbitration board of the World Watch and Jewelry Show in Basel, Switzerland, has rejected the complaint filed by Swiss watchmaker Omega against Tianjin Seagull Watch Group over trademark infringement.

The board ruled on Saturday that the promotional material used by Tianjin Seagull didn't violate the intellectual property rights of the luxury Swiss watch manufacturer, Xinhua News Agency reported yesterday.

Tianjin Seagull displayed its latest tourbillion women's watch at the annual show.

Omega filed a complaint on March 9, claiming that Seagull used the word "co-axial" in its promotional materials and accused it of trademark infringement.

Omega registered two trademarks: "? OMEGA CO-AXIAL" and "CO-AXIAL 3."

Seagull defended that co-axial was used as an adjective to describe the watch, rather than a trademark.

The board sided with Seagull and rejected the lawsuit.
