Supreme court opens new arm
CHINA’S Supreme People’s Court yesterday inaugurated its second circuit court in Shenyang, capital of Liaoning Province.
The judicial organ will primarily handle major administrative, civil and commercial cases in the northeastern provinces of Liaoning, Jilin and Heilongjiang, the SPC said.
The First Circuit Court of the SPC was inaugurated on Wednesday in Shenzhen, Guangdong Province. It will serve Guangdong and Hainan provinces and the Guangxi Zhuang Autonomous Region.
The establishment of the new courts, both of which will begin taking cases from today, is part of a reorganization designed to better allocate workloads across the judicial system.
Their judgements, orders and decisions are equal to those of the SPC, and all judges working in them will be selected and sent by the top court.
Sun Jungong, a spokesman for the SPC, said the locations of the circuit courts were chosen based on “local social and economic development and judicial work.”
Shenyang was selected because of its high volume of disputes resulting from the structural transformation of the economy in the former industrial base.
The creation of the circuit courts will help better protect the rights of litigants by ensuring protectionism doesn’t influence cases, said Hu Yunteng, president of the Shanyang court.
They will also free up the SPC headquarters to concentrate on policy-oriented work by reducing the number of lawsuits it handles, he said.
The jurisdiction of China’s local courts is largely consistent with administrative divisions, and the promotion of judges and financing are influenced by local governments.
There have long been concerns that authorities might sometimes interfere in and influence court rulings.
