20 years after divorce UK tycoon faces ex-wife claim

A former hippy whose ex-husband made a fortune after their 1992 divorce yesterday won the right to seek a chunk of his wealth in a landmark British court ruling.

Kathleen Wyatt wants a 1.9 million pounds (US$2.9 million) payout from green energy tycoon Dale Vince 鈥 despite lodging her claim 20 years after their divorce.

Five Supreme Court judges ruled in Wyatt鈥檚 favor on Monday following a hearing in December 鈥 a decision 53-year-old Vince branded 鈥渕ad,鈥 warning it could open the floodgates for claims on relationships which ended decades ago.

The pair met as students, married in 1981 and lived a 鈥淣ew Age Traveller鈥 hippy lifestyle on the road. They had one son.

They separated in the mid-1980s and divorced in 1992. A few years later, Vince founded Ecotricity, which claims to be 鈥渢he world鈥檚 first green electricity company鈥, supplying power from renewable sources. The BBC said Vince started out using a wind turbine he had made to power his caravan, and was now worth an estimated 107 million pounds.

Wyatt, 55, lodged her claim for 鈥渇inancial remedy鈥 in 2011. The High Court accepted her bid but the Court of Appeal overturned the decision. Now the Supreme Court 鈥 the highest in the land 鈥 has ruled the case should go ahead in the lower High Court.

Judge Lord Nicholas Wilson said Wyatt鈥檚 claim was 鈥渓egally recognizable鈥 and not an 鈥渁buse of process.鈥

He said a 1.9-million pound payout was 鈥渙ut of the question鈥 and could even be dismissed 鈥 but the judges thought that there was a 鈥渞eal prospect鈥 she would get a 鈥渃omparatively modest award.鈥

The judge said Wyatt had raised their son in 鈥渉ardship鈥 and the court must have regard 鈥渢o the contribution of each party to the welfare of the family.鈥
