US govt to appeal ruling on immigration
The United States Justice Department will appeal a federal judge’s ruling that temporarily blocked President Barack Obama’s executive action on immigration, the White House said yesterday.
On Monday, US District Judge Andrew Hanen in Texas issued a temporary injunction, giving a coalition of 26 states time to pursue a lawsuit that aims to permanently stop the orders.
It puts on hold Obama’s orders that could spare as many as 4 million people in the US illegally from deportation.
In a statement, the White House said Monday’s ruling “wrongly prevents” the president’s “lawful, commonsense policies” from taking effect.
The Justice Department, legal scholars, immigration experts and the federal district court in Washington have determined that Obama’s actions are well within his legal authority, the White House said.
The first of Obama’s orders, to expand a program that protects young immigrants from deportation if they were brought to the US illegally as children, was set to start taking effect today.
Hanen’s decision does not judge the merits of the case, but it is a blow to an Obama initiative that infuriated Republicans.
Obama took the measures November, saying he had to act because bilateral to reform the country’s immigration system was stalled in the Republican-controlled House.
Republicans leaders said Obama’s unilateral move would make it more difficult to get bipartisan legislation through Congress. Congressional Republicans are now vowing to block Obama’s actions on immigration by cutting off Homeland Security Department spending for the program.
Hanen wrote in a memorandum accompanying his order that without a preliminary injunction the states will “suffer irreparable harm.”
