Environmental ruling may see new Perth Freight Link tender process

The West Australian Government may have to conduct a new tender process for the first stage of its proposed $1.6 billion Perth Freight Link project.

Leighton Contractors was selected as preferred tenderer for the Roe Highway extension from Kwinana Freeway to Stock Road.

But the project was put on hold for at least a year after the WA Supreme Court ruled the environmental approvals for Roe 8 were invalid.

The Government is appealing against that decision, but has been forced to review how it will proceed.

If the ruling is upheld, it is unclear whether the Government would have to not only re-start the environmental approvals process, but also let a new tender process take place for Roe 8.

Transport Minister Dean Nalder met Main Roads yesterday, and said the Government was considering a range of options.

"We're obviously going through an appeal process, we need to run through that," he said.

"We're working closely with the tenderers, or the department [of Transport] is, and I'm waiting on them to provide me advice on what options might be available.

"One of the options would be to re-do the full tender. My preference would be that if we don't have to, don't do it at this stage. But we need to see how things progress.

"We need to engage with the tenderers themselves and make sure that we're all on the same page. We're all in this together."

Tenderers may be compensated for delay

The State Government is also considering whether it will have to pay out the preferred tenderer for the delayed Roe Highway extension.

With construction now delayed at least a year, Transport Minister Dean Nalder said the Government may have to meet some of the costs for Leighton and other tenderers.

"We will look at those options. It may be that we pay both of them out as though they have lost the tender but then recoup it when one is successful," he said.
