J&J not to appeal after price-fixing ruling

Johnson & Johnson today said it refrains from appealing to the Supreme People’s Court after the company was ordered to pay for price fixing by a court in Shanghai.
 
Johnson & Johnson Medical (China) Ltd said it is “disappointed” with a Shanghai Higher People’s Court ruling that it has violated China’s anti-monopoly law, but the company is pleased to “have put this matter behind.”
 
The Shanghai court yesterday revoked a previous verdict and ruled that J&J pay 530,000 yuan (US$86,397) in compensation to Rainbow Medical Equipment & Supply Co, a former dealer in the US pharmaceutical giant’s products.
 
The court described J&J as a “vertical monopoly” after it deprived the Beijing firm of its dealership in 2008, halting suppliers after the Beijing dealer was found taking orders for products below a minimum price set by the company.
 
The case made Beijing Rainbow the first company to win an anti-monopoly case in China with a final verdict.
