Guide details conduct of trials in city鈥檚 FTZ
THE Shanghai No.1 Intermediate People’s Court yesterday released a guideline to govern trials of disputes related to the city’s pilot free trade zone as part of efforts to improve legal support for reforms and innovations in the zone.
The guideline, effective from tomorrow, lays out principles, methods and steps involved in trials covering contract, finance, intellectual property rights, labor disputes, real estate and other criminal offenses.
“The guideline will provide judges with direction in hearing cases involving the free trade zone, and the guideline will be further improved,” said Chen Libin, the president of the court.
As financial reform is one of the top priorities in the zone, the guideline said the hearing of disputes involving financial innovation should follow international practices.
“Although there are still no applicable rules and laws for some innovative activities in the financial field, the agreements between parties should be fully respected as long as financial order and safety are guaranteed,” said the guideline.
The rules for the protection of patent rights, trademark rights and copyright should be specified in order to heighten intellectual property right protection in the zone.
To enforce laws, the court will consider using bailiffs who will deliver summons and orders to defendants and execute the decisions of the court.
