Drug firm sues for trademark breach
GUANGZHOU Pharmaceutical Co is suing two retailers for a total of 1 million yuan (US$158,730) in compensation for selling a herbal tea under the "Wong Lo Kat" name, which the drug firm has exclusive use of.
Two courts in Guangdong Province have accepted the case, Guangdong King Bridge Best Law Firm, which is representing the drug firm, said yesterday, web portal NetEase reported.
The two retailers being sued are Dongguan Jiarong Supermarket Co and Guangzhou New Supply Trade Co. They are alleged to sell the "Wong Lo Kat" tea made by the JDB Group, a unit of Hong Kong-based Hung To (Holdings) Co.
The JDB Group has been prevented since May 2 from using the "Wong Lo Kat" trademark for its herbal tea products by the China International Economic and Trade Arbitration Commission.
Guangdong Mingjing Law Firm, another legal advisor of Guangzhou Pharmaceutical, said the JDB Group continued to produce the red can herbal tea with "Wong Lo Kat" logo after the arbitration ruling, which hurts Guangzhou Pharmaceutical's interest.
The drug firm will also ask law enforcement authorities and local commercial bureaus to prevent JDB from selling products under the "Wong Lo Kat" brand, said Tang Yaojun, a lawyer with Mingjing Law Firm.
Guangzhou Pharmaceutical said it still reserves the right to claim the illicitly acquired interests of JDB at a nationwide level.
