Regulation on travel agencies
THE travel season is approaching, together with potential problems along the way. The new Regulation on Travel Agencies has been released this year with some new rules.
A major update of the previous regulation is to state clearly that the travel agency should sign contracts in written form with the tourists. The key issues in the contract are also listed in the regulation. Tourists should pay attention to whether the agency uses "Shanghai Contract Model Text of Domestic Tourism" and "Shanghai Contract Model Text of Outbound Tourism."
The regulation forbids statements like "potential three-star hotel," "the same level with three-star hotel," or "luxurious trips." Statements about accommodation standards, the trip and prices should be clear. The tourism information offered by the agency should be true and valid. The agency offering outbound trips should hold a relevant license.
Tour guides should comply strictly with the contract and not change the itinerary at random. If uncontrollable social events occur, the guide should inform the tourists in time.
The contract should state clearly how many shopping tours are in the trip, the time period for shopping and names of the shops. Any types of fraud or forcing travelers to shop are prohibited.
If facing any problems during the trip, travelers can complain to the district tourism bureau, city tourism bureau, department of administration for industry and commerce, price management department, responsible commercial department or the foreign currency management department. For any disputes concerning the contract, the traveler can apply to arbitration organizations or go to court. The regulation requires clear statements about the system of supervision.
