The problematic home balconies
MORE than 600 property owners in the Poly-Jasmine Mansion residential complex on Puxiu Road have received official notices demanding them to dismantle the added structures to their apartments that violate the law.
The 3-year-old complex houses 1,300 families. One resident said he received the notice about a month ago, but it didn’t specify which part of his apartment was “illegal.”
“We heard that most of the problems relate to balconies,” said the resident. “The balconies were a ‘complimentary’ addition from the developers and not included on ownership certificates. But so far the developers haven’t responded to our requests for information.”
Another property owner, who only defined himself as Chen, said the villa he bought had the frame for a balcony but no floor.
“The salesman told me the balcony area was ‘complimentary,’ but I had to install the flooring myself, or wait until all the procedures were completed for the developers to install it,” he said. “But most of the owners were impatient and didn’t want to wait.”
The residents were worried that the developers would pass the buck and they would bear great loss.
The Minhang Urban Management Administrative Bureau said that there were no “complimentary balconies” on the developers’ blueprint and the balconies installed by residents might not meet safety standards.
The balconies were built after the official inspection of the construction project, so they are technically illegal.
Song Ancheng, a property law expert, said that the developers appear to bear legal liability because the problem was caused by their improper promotion.
