Boy wins lawsuit over escalator accident

A 4-year-old boy who was injured when his left foot got stuck in a shopping mall escalator for about one hour last summer will get 94,000 yuan (US$15,134) in compensation from the mall, a Pudong District court ruled yesterday.

The accident happened last July when the escalator stopped abruptly and then moved again, felling the boy and his grandmother. The boy's foot got wedged in the side gap of the escalator for about one hour, the court heard.

The boy was later sent to the Shanghai Children's Medical Center where doctors said his toe may have problems stemming from the injury. Hence, his family brought the shopping mall to court.

The shopping mall, not revealed by the court, argued that the escalator was well maintained and the boy naughtily poked his foot in the gap. His grandmother was also responsible as she failed to take care of the boy.

The court said the grandmother has no fault because she was holding the boy's hand at the time and there was no evidence to prove the boy was naughty. It ordered the shopping mall to compensate the boy because an escalator glitch caused the accident.
