Court denies US husband's home ownership

JING'AN District People's Court has denied a man's ownership of an apartment and ruled the ownership was shared by his divorced wife and her mother, today's Shanghai Morning Post reported.

The man and his former wife, both from the United States, bought the apartment in Shanghai in 2005 for 3.25 million yuan (US$476,000), the court heard.

The ex-wife's mother covered all the down payment and the couple paid the mortgage. She asked the couple to sign an agreement that she had the major ownership of the home.

In 2008 the couple got divorced and the man asked the ex-mother-in-law to return the home to him and denied he had signed the agreement on ownership. He stopped paying the loan which was handed over by the ex-mother-in-law.

The court backed the ex-mother-in-law's ownership and ruled she owns part of the home and her daughter owns the rest. But the court asked her to pay 100,000 yuan in compensation to the man for the refurbishment he had paid for.
